| Disclosure of Prior Art |

- In the Notice Prior to Examination, the Israel Patent Office requires submission of a list of all citations relied upon by foreign patent authorities when examining corresponding applications. To be able to demonstrate that the applicant has acted in good faith at all times, JMB, Fa©tor & Co. recommends submitting a list of all documents which were cited in all search reports or otherwise made of record, including those cited in Office Actions in all corresponding applications, or listed in the USPTO "Notice of References Cited by Examiner," even if these references were not specifically relied upon during examination. Furthermore, a copy of Information Disclosure Statements (IDS) from corresponding US applications should also be submitted along with all other prior art of record. In contentious proceedings failure to bring relevant prior art to the attention of the examiner may be used to challenge the validity of any issued patent.
- Unless Modified Examination is requested), the applicant is required to submit full copies of all citations made against novelty and inventive step. This includes documents designated as
X or Y in the International Search Report of corresponding PCT applications.
- For citations not in English, an English translation, an English-language equivalent, or at least an English abstract should be submitted together with the document, if available.
- The Patent Office has requested that prior art be submitted on CD media. Accordingly, please end the documents on a CD, as e-mail attachments, or authorize
JMB, Fa©tor & Co. to obtain copies of these documents ourselves.
Note that there exists an ongoing duty of disclosure until allowance.
